Deferred Action For Childhood Arrivals

DACA renewals for individuals whose DACA expired on or after September 5, 2017

Individuals whose DACA expired on or after September 5, 2017, can now renew their status and employment authorization by filing the appropriate forms with the USCIS. Unfortunately , advanced parole requests are not being currently processed. 

New initial DACA requests for individuals whose DACA expired before September 5, 2017

Those individuals whose DACA expired or was terminated before September 5, 2017 will have to file a new initial DACA request. with the USCIS. They need to notify USCIS of the date their prior DACA expired or was terminated. 

First time initial DACA applicants

Unfortunately, individuals who have never been granted DACA previously are not eligible at this time to apply. 


However, it is hoped that this will change soon in the near future if/when congress passes legislation to offer a path to legalization for the DACA eligible. 

Work Permits

EADs or work  permits of DACA recipients remain valid until their expiration or termination date. Note: if you have a valid EAD, but your DACA has ended, you have no legal obligation to inform your employer about your DACA status. Your employer should only be concerned with your EAD and not the underlying legal status that enabled you to get the EAD.
